【中文摘要】 我们知道，价值观往往决定着人们研究某一事物的价值走向，当人们研究刑事政策的时候就赋予其生命，而价值则是刑事政策生命之灵魂；刑事政策的价值取向既是一种价值观又是一种价值论，无论浅显抑或深刻都是一种超越具体刑事政策制度和刑事政策行为的东西。要想深入到刑事政策的灵魂深处，挖掘其本质，唯有将刑事政策体系置于价值的平台上才能做得更为酣畅淋漓。特别是在当前建设法治国家的现实要求下，剖析刑事政策的价值对于研究刑事政策基本理论、探求刑事政策内涵、搭建科学合理的刑事政策体系具有重要的理论和实践意义。 本文共分引言、正文和结语三个部分。 引言以价值的视角对以往的概念进行梳理，意在考察隐藏在诸多概念背后研究者的价值观以及他们面对价值冲突时做出的抉择即价值取向，运用价值分析方法提出新的刑事政策的概念。 正文分为三章： 第一章刑事政策的价值范畴：简要分析价值、法律价值的内涵、特征以及层次，期望为解析刑事政策价值的内涵、特征、内容以及层次做铺垫。在这一章里重点分析了刑事政策价值与刑事政策目的和刑事政策目标之间的区别，剖析了刑事政策价值的正义、自由、秩序、效益以及人类的全面发...
